| The Privacy Passport® Plus is the ideal Asset Protection vehicle because it takes advantage of both Trust and Corporate legal opinions while avoiding some of the negative implications of both systems. If the client has control over the assets of a trust, courts have held that this effective control over the assets negates the benefits of the trust. On the other hand, the same courts rule in exactly the opposite manner when it comes to corporate entities since corporate law is based solely on the proposition that the shareholder cannot be made liable for the actions of the company (subject to following the necessary "corporate formalities". By having all the assets held by an Offshore Company, which in turn is owned by our carefully designed Offshore Trust, the client does not have to fear loss of the Asset Protection features of the Trust or the Company. Also, the system may be able to deliver significant tax reduction.
